General Terms and Conditions of Sale


Effective Date: July 1, 2025


Please read the following Terms and Conditions of Use carefully, as they govern all transactions and interactions with Clear Path Systems, LLC and its affiliated auction platform, Clear Path Auctions (“Clear Path”).


By registering to bid or participating in any auction, you (“Buyer” or “Registrant”) acknowledge and agree to be bound by the following terms:


1. Modifications and Termination of Service


Clear Path Systems reserves the right to update, modify, or amend these Terms at any time without notice.

We reserve the right to refuse or terminate service to any individual or entity at our sole discretion, without prior notification or stated cause.

In unforeseen or extraordinary circumstances, Clear Path reserves the right to retract bids or void transactions at any time before or after auction close.


2. Registration & Bidding Eligibility


All bidders must register prior to placing bids. By registering, you warrant that all provided information is true, accurate, and complete.

Participation in an auction constitutes acknowledgment and acceptance of these Terms, including any modifications announced by the auctioneer before or during the sale.


3. Precedence of Announcements


Any announcements made on auction day take precedence over previously distributed material or online listings.


4. Payments and Taxes


Payments must be made to Clear Path Systems, LLC via wire transfer, credit card, or cash only.

Local/state sales tax will apply unless a valid exemption certificate is provided prior to payment. Buyers without such documentation are liable for all applicable taxes.

A buyer’s premium, as displayed or announced, applies to all purchases.


5. Bidder Responsibilities


Buyers are strongly encouraged to inspect items before bidding. All items are sold AS IS, WHERE IS, with no warranties or guarantees.

Placing a bid constitutes a binding offer and acceptance of all terms.


6. Auction Conduct & Disputes


Auctioneer decisions are final and binding.

In the event of a dispute, the auctioneer reserves the right to re-offer the item for sale.

Auctioneer may accept or reject bids in any increment in the interest of the seller.


7. Bidding Extensions


To prevent last-second “sniping,” bidding may be automatically extended during high activity near closing. The item will only close when bidding ceases for the final extension period.


8. Absentee Bidding


Absentee bids are accepted when possible as a courtesy, but Clear Path is not liable for execution errors.


9. Buyer’s Risk and Liability


Risk transfers to the buyer at the close of bidding.

Buyers agree to indemnify Clear Path and the seller from all claims related to removal, transportation, use, or condition of purchased goods.

Buyers assume full liability for damage to property or structures during item removal.


10. Item Descriptions


All descriptions are believed accurate but not guaranteed. Buyers are responsible for verifying all details before bidding.

No claims will be honored after item removal or after the time specified by the auctioneer.


11. Item Removal


Items must be paid for in full and removed within the stated timeframe. No early removal is permitted.

Failure to remove items in time may result in storage fees, abandonment, or resale at buyer’s expense.


12. Non-Compliance


If a buyer fails to comply with these Terms, Clear Path may retain deposits and resell items at buyer’s expense.

Original buyers are responsible for any losses from resale.


13. Withdrawal & Lot Changes


Clear Path reserves the right to withdraw any item from sale or to add/group/subdivide lots at its discretion.

Export Disclaimer


Clear Path does not provide shipping, freight forwarding, customs brokerage, or export documentation services of any kind.


Upon full payment, all responsibility for transportation, compliance, and export clearance transfers to the buyer.

Buyers are solely responsible for complying with all applicable U.S. export laws and regulations, including those governed by:


Bureau of Industry and Security (BIS)

Office of Foreign Assets Control (OFAC)

U.S. Census Bureau (AES filing, if applicable)


Clear Path reserves the right to deny or cancel any transaction suspected of violating U.S. export or sanction laws.

Final Acknowledgement


By placing a bid or making a purchase, the Buyer agrees to be bound by all Terms and Conditions set forth herein.


Inspections: July 21 thru July 24 - By appointment only


Bidding Starts:  July 21, 2025


Bids close:  August 6 at 10AM to 9PM CST


Removal:  Onsite packaging, rigging and loading services are available. All provider recommendations are provided as a courtesy. Removal times are approximately 3 weeks after the sale and will be updated prior to open bidding.
